Terms of Service

Welcome to Monsera. These Terms of Service set out how our shop works and what you can expect from us — and what we ask of you in return. They apply to every visit to monsera.eu and to every order you place with us. Please read them carefully; by using our website or placing an order, you agree to them.

Nothing in these terms limits the rights you have as a consumer under the law of the European Union or of your country of residence.

1. Who we are

Monsera is a trade name registered with the Netherlands Chamber of Commerce (KvK) under number 97175625, VAT number NL005253405B41.

2. Scope

These terms apply to all offers, orders and agreements between Monsera and you. Our Shipping Policy, Returns & Refunds Policy and Privacy Policy form part of these terms.

3. Using our website

You must be at least 16 years old to place an order, or have the consent of a parent or guardian. You agree to provide accurate information when ordering and not to use our website for any unlawful purpose, to interfere with its operation or security, or to infringe the rights of others.

4. Our products

We describe and photograph our products as accurately as we can. Colours may vary slightly depending on your screen. Several of our products — such as our gua sha stones and jade rollers — are made from natural stone; every piece has its own colour and veining, and small variations are part of their character rather than a defect.

Our grooming and self-care tools are cosmetic accessories. They are not medical devices and are not intended to diagnose, treat, cure or prevent any condition. Descriptions of effects such as “helps de-puff” refer to cosmetic, temporary effects and may vary from person to person.

5. Prices and payment

All prices are shown in euros and include VAT. Shipping costs are shown separately at checkout before you pay. We accept the payment methods displayed at checkout; payments are processed securely by our payment providers and we never see or store your full card details.

We may change prices at any time, but the price shown when you place your order is the price you pay. If a product is clearly mispriced because of an obvious error, we may cancel the order and refund any amount paid in full.

6. Orders and contract

Your order is an offer to purchase. The agreement is formed once we send you an order confirmation by email. We may decline or cancel an order — for example if a product is unavailable, in the event of an obvious pricing error, or where we reasonably suspect fraud. In that case, we will inform you and refund any payment in full.

7. Delivery

We deliver to the countries listed in our Shipping Policy. Delivery times are estimates. Ownership and risk of loss pass to you once the order has been delivered to you or to a person you have designated.

8. Right of withdrawal

As a consumer in the EU, you have the right to withdraw from your purchase within 14 days of receiving it, without giving any reason. How this works, and the conditions that apply, are explained in our Returns & Refunds Policy.

9. Legal guarantee

All products come with the legal guarantee of conformity under EU and Dutch law, which lasts at least two years from delivery. If a product is defective or does not match its description, contact us and we will repair, replace or refund it in line with your statutory rights. This guarantee does not cover normal wear and tear, damage caused by misuse, accidents, improper care or modifications, or natural variations in natural materials.

10. Product use and safety

Our products are designed to be used as described on the product page and in any instructions supplied with them. Please read these carefully before first use. In particular:

• Sharp objects. Safety razors, razor blades and the tools in our grooming kits are sharp. Handle them with care, change blades carefully, never test an edge with your fingers, keep them out of reach of children and dispose of used blades safely.
• Skin contact. Shaving brushes, cleansing brushes, gua sha stones, facial rollers, ice rollers and similar tools come into direct contact with your skin. If you have sensitive skin, allergies or a skin condition, carry out a patch test on a small area (for example the inside of your wrist or behind your ear) and wait 24 hours before regular use. If in doubt, consult a doctor or dermatologist first.
• Stop if irritation occurs. Discontinue use immediately in case of redness, irritation, pain or any other adverse reaction, and seek medical advice if symptoms persist. Do not use on broken, inflamed or irritated skin.
• Cold tools. Keep ice and chilled tools moving on the skin and never hold them in one place for long.
• Hygiene. Clean your tools as instructed and do not share personal grooming tools with others.

You use our products at your own risk and responsibility. Monsera is not liable for injury, irritation or damage caused by incorrect use, use contrary to the instructions or warnings, use for a purpose other than intended, failure to carry out a recommended patch test, or failure to follow the care instructions. Safety notes are also included on the relevant product pages.

11. Limitation of liability

To the maximum extent permitted by applicable law:

• our total liability in connection with an order is limited to the amount you paid for that order;
• we are not liable for indirect or consequential loss, such as loss of income or profit;
• we are not liable for damage resulting from misuse or incorrect use of our products as described in section 10.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for damage caused by intent or gross negligence, for liability under product liability law, or for any other liability that cannot be excluded or limited by law. Your statutory rights — including your 14-day right of withdrawal and the legal guarantee of conformity — are not affected.

12. Intellectual property

All content on this website — including texts, photographs, logos, designs and the Monsera name — belongs to Monsera or its licensors and may not be copied, reproduced or used for commercial purposes without our prior written permission.

13. Reviews and messages

If you send us reviews, comments or other content, you confirm that it is truthful and your own, and you grant us the right to use, publish and edit it in connection with our brand. We may remove content that is unlawful, offensive or misleading.

14. Force majeure

We are not responsible for delays or failures caused by circumstances beyond our reasonable control, such as strikes, carrier disruptions, extreme weather, pandemics or government measures. We will keep you informed and, if an order cannot be delivered within a reasonable time, you may cancel it for a full refund.

15. Privacy

We handle your personal data with care and in accordance with the GDPR. Read our Privacy Policy to learn more.

16. Changes to these terms

We may update these terms from time to time. The version published on our website at the moment you place your order applies to that order.

17. Governing law and disputes

These terms are governed by Dutch law. If you are a consumer living in another EU country, you also keep the protection of the mandatory consumer law of your country of residence. Disputes may be brought before the competent court in the Netherlands or, as a consumer, before the court of your place of residence.
